These terms govern your use of Feraust. By creating an account or using the service, you agree to them. If you don't, don't use the service — it's that simple.
I've tried to write these in plain language. If anything is unclear, email me at support@feraust.com and I'll explain or rewrite it.
Who runs this
Feraust is operated by RadOrigin LLC (the "I" / "we" below). It's a solo-developer project. Response times are human-scale.

Your account
You must be at least 13 years old to use Feraust. If you're under 18, you need a parent or guardian's permission.
One account per person. You're responsible for keeping your password secure. If you suspect your account is compromised, email me immediately.
You agree to give accurate information at signup and to keep your contact email current. The email is how I reach you about safety, billing, and account changes.
Acceptable use
Don't use Feraust to harass wildlife, bait animals, bypass park rules, or do anything else that violates local wildlife-protection law. The whole point of the app is the opposite of that.
Don't attempt to scrape, reverse-engineer, or overload the service. Don't create multiple accounts to circumvent free-tier limits — one person, one account.
Don't upload other people's photos as your own, CSAM, or anything else that would violate someone else's rights.
Violations can result in immediate account termination without refund.
Safety check-in — important limitations
The safety check-in is a best-effort escalation tool. When you miss your timer, Feraust attempts to email your emergency contact. That's it. It is not a guaranteed emergency service, an alternative to a PLB or satellite communicator, or a substitute for filing a proper trip plan with someone you trust.
Email delivery can fail for reasons outside my control: recipient spam filters, email provider outages, network failure between your device and my server, a dead phone battery before the timer runs out, a cellular dead zone, a full inbox, a misconfigured emergency contact address. I cannot guarantee that a missed check-in will result in a message reaching anyone.
You must carry appropriate emergency equipment for your conditions. In remote environments, that means a Personal Locator Beacon (PLB), satellite communicator (Garmin InReach, ZOLEO, etc.), or equivalent device with a tested two-way communication path to search and rescue. The check-in feature is a convenience, not a safety system.
You agree that RadOrigin LLC is not responsible for the consequences of a failed or delayed check-in delivery, and that the check-in does not create a duty of care between me and you or your emergency contacts.
AI-generated content
Features marked "AI-generated — review carefully" produce suggestions from large language models (Gemini, Claude). Output may be incorrect, outdated, or inappropriate for your specific situation. Species identification, ethics advice, and trip plans generated by AI are starting points for your own research, not authoritative answers.
Do not rely on AI output for legal compliance (permits, protected-species regulations, wildlife-viewing laws). Always verify against the primary source — the park service, the wildlife agency, or your local licensed guide.
AI features consume your monthly AI quota. See your account page for current usage.
Your content
Your pins, trips, photos, and observations remain yours. You grant Feraust a limited license to store, display, and process them for the purpose of providing the service to you. That's the full scope — no resale, no ad targeting, no training-data licensing.
If you make a pin public, other users can see it subject to the tiered location blur (free viewers see 1 km, Pro viewers see 250 m, sensitive species are always blurred to 10 km). You can change the public flag or delete the pin at any time.
Photos uploaded to pins are re-encoded and stripped of EXIF metadata (including GPS) before storage. This is non-optional.
Payments, trials, and refunds
Premium subscriptions (monthly and annual) are processed by Stripe. You authorize Stripe to charge your payment method on the billing cycle you selected. Prices are displayed in U.S. dollars and may change — existing subscribers are grandfathered into their current price until they cancel.
Premium Lifetime is a one-time purchase limited to the first 100 customers. It grants Premium-equivalent entitlements indefinitely, subject to the same monthly AI quota as the subscription tier. "Lifetime" means the lifetime of the Feraust service; I cannot guarantee the service runs forever.
The 3-day free Premium trial activates when you confirm your email. It's one per account. Trials do not auto-convert to paid — you have to explicitly choose a plan to stay on Premium after the trial ends.
Refunds: monthly subscriptions are not refunded for unused time. Annual subscriptions are refunded pro-rata if you cancel within the first 14 days. Lifetime purchases are refunded in full if requested within 14 days of purchase. Disputed charges pause your account until resolved.
Beta invite codes grant Premium entitlements for the validity window of the code (typically 60 days). Beta codes do not create a payment obligation.
Termination
You can delete your account at any time from account settings. Deletion removes your pins, trips, photos, and personal data within 30 days.
I can terminate accounts that violate these terms. In severe cases (wildlife harassment, fraud, abuse of other users) termination is immediate and without refund.
I can shut down Feraust entirely. If that happens, I'll give at least 30 days' notice and provide a data export path. Pre-paid annual / Lifetime customers will be refunded for unused time on a pro-rata basis.
Disclaimer of liability
Feraust is provided "as is," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Wildlife photography involves inherent risks — you assume those risks.
To the maximum extent permitted by law, RadOrigin LLC's total liability to you for any claim arising from the service is limited to the amount you paid me in the 12 months preceding the claim, or $100, whichever is greater.
I am not liable for indirect, incidental, consequential, or punitive damages, including loss of data, loss of wildlife sightings, lost photography opportunities, or safety outcomes.
Nothing in these terms limits liability for death or personal injury caused by my gross negligence, or for fraud.
Beta disclosure
Feraust is currently in beta. Features may change, break, or disappear. Data loss is possible during this period — back up anything you can't afford to lose.
Beta testers may receive invite codes that grant Premium access for a limited window. These codes are a courtesy, not a contract — they can be revoked at any time.
Changes to these terms
I may update these terms from time to time. Material changes get emailed to account holders at least 14 days before they take effect. The "Last updated" date at the top of this document always reflects the most recent change.
Continuing to use Feraust after an update constitutes acceptance of the updated terms. If you don't agree with a change, email me — I'll cancel your subscription and refund per the refunds section above.
Governing law
These terms are governed by the laws of the State of California, U.S.A., without regard to its conflict-of-laws principles. Any dispute arising from the service will be resolved in the state or federal courts located in the San Francisco Bay Area. You consent to personal jurisdiction in those courts.
If any part of these terms is held unenforceable, the rest remain in effect.
